Prosecutors Not to Challenge Ken Lay Vacation of Conviction

Federal prosecutors will not challenge a judge?s ruling that vacates the conviction of Enron?s founder, Kenneth L. Lay, who died in July, prosecutors said on Monday.

Prosecutors withdrew their notice of appeal in the ruling, asking the United States Court of Appeals for the Fifth Circuit to review it. The notice came the same day that a bill was introduced in the Senate that would keep federal convictions in force when a defendant dies, allowing victims to continue seeking restitution.
